Facts about Kitec Piping Lawsuits & Class Action Lawsuits

If you are not sure, you should check because thousands of homeowners in the United States of America and Canada whose properties have Kitec piping installed will be able to share in a proposed $125 million class action lawsuit settlement over the fact that Kitec piping turned out substandard and defective.
Several class action lawsuits have been filed in the US. and Canada against the manufacturer of Kitec piping over its primitive failure that resulted in leaks, flooding, or damages to the structures where they were installed. Besides, many lawsuits sought redress for their damaged properties (water damage) due to leakage or pipe burst of Kitec piping. The case is collectively called “In Re: Kitec Plumbing System Products Liability Litigation.” Meanwhile, the proposed IPEX Kitec plumbing class action settlement is intended to cater to all the class action lawsuits filed.

For the purposes of this write-up:
the United States Class, the Canadian National Class, and the Quebec Class are referred to as the Class.
A “Settlement” catering to Class claims in all related cases has been negotiated on behalf of the Class by Class Counsel and with Defendants IPEX Inc. and IPEX USA LLC and its predecessor IPEX USA Inc. and IPEX Distribution Inc. (collectively, “IPEX Defendants”) and related entities.
The Settlement involves a one hundred and twenty-five million U.S. dollar (US$125,000,000) Settlement Fund (including attorneys’ fees and costs) to be used for the benefit of Class Members to pay for the repair of buildings, homes, residences, or any other structures with a Kitec System.
The Classes:
The settling parties have consented to the Court’s certification of the following classes of persons with regard to claims concerning the Kitec System, which may include some components, individuals parts, or an entire system, PEX pipe, PERT-AL-PERT, PE-AL-PE, PEX-AL-PEX, fittings, valves, and/or components manufactured by or sold on behalf of IPEX.

Kitec Plumbing In the United States:
The United States District Court for the Northern District of Texas, acting under authority from the Judicial Panel for Multi-District Litigation, certified a United States Class for settlement purposes only as follows:
All persons that lease, have leased, own, or have owned, as well as all those who may or have pursued claims on behalf or in the right of those who lease, have leased, own, or have owned houses, residences, buildings, or any structures located in the United States that contain Kitec piping manufactured and/or sold by the IPEX Defendants, except only the Clark County Class. For purposes of this definition, individuals and entities shall include any or all of the individuals’ or entities’ spouses, heirs, joint owners, executors, agents, attorneys, trusts and trustees, subsequent owners or occupants, assignees, subrogees, successors, predecessors, lenders, creditors, tenants, mortgagees, insurers, administrators, and assigns and every individual entitled to lay a claim on behalf thereof.
Kitec Plumbing In All Of The Provinces And Territories Of Canada:
The Ontario Superior Court of Justice has certified a Canadian National Class for settlement purposes only as follows:
All persons that lease, have leased, own, or have owned, as well as all those who may or have pursued claims on behalf or in the right of those who lease, have leased, own, or have owned houses, residences, buildings, or any structures located in Canada, except only the members of the Quebec Class, that contain Kitec piping manufactured and/or sold by the IPEX Defendants. For purposes of this definition, individuals and entities shall include any or all of the individuals’ or entities’ spouses, heirs, joint owners, executors, agents, attorneys, trusts and trustees, subsequent owners or occupants, assignees, subrogees, successors, predecessors, lenders, creditors, tenants, mortgagees, insurers, administrators, and assigns and every individual entitled to lay a claim on behalf thereof.
For Certain Owners And Lessees In The Province Of Quebec, Canada:
The Superior Court of Quebéc has authorized a Quebéc Class for settlement purposes only as follows:
All natural persons including all legal persons established for a private interest, associations, and partnerships having up to 50 persons bound to it by contract of employment under its direction or control during the 12-month period preceding the motion of authorization (November 27, 2009), that lease, have leased, own, or have owned, as well as all those who may or have pursued claims on behalf or in the right of those who lease, have leased, own, or have owned houses, residences, buildings, or any structures located in Quebec that contain Kitec piping manufactured and/or sold by the IPEX Defendants. For purposes of this definition, individuals and entities shall include any or all of the individuals’ or entities’ spouses, heirs, joint owners, executors, agents, attorneys, trusts and trustees, subsequent owners or occupants, assignees, subrogees, successors, predecessors, lenders, creditors, tenants, mortgagees, insurers, administrators, and assigns and every individual entitled to lay a claim on behalf thereof.
Kitec piping or systems include all of, whether components, individuals parts, or an entire system, PEX pipe, PERT-AL-PERT, PE-AL-PE, PEX-AL-PEX, fittings, valves, and/or components manufactured by or sold on behalf of IPEX Defendants.
